General Terms

General terms and conditions regulate the relationship between the Customer and Arthur and Friends webshop. The Customer is requested to read carefully the general terms and conditions before placing an Order. Arthur and Friends will send a copy of the following Terms and Conditions to the customer upon request. Arthur and Friends remains the possibility of adjusting the below Terms. We pay attention on the correctness and presence of the agreement below but errors can occur and we can not be held responsible if they do.

PRODUCT

Each product shown by Arthur and Friends is described and photographed in detail. Arthur and Friends reserves the right to show all the products as exact as possible but we cannot guarantee that the products seen on screen are the same as in reality. Please note that we reserve the right to alter minor details of the products featured on this site and in other informational materials we provide in the interest of maintaining product quality and design integrity. Accordingly, products shipped to you may differ slightly from those depicted on this site or in such materials. The buyer is responsible for the correct assembly of the supplied products following instructions shipped within the packaging.

All the Products available on the Arthurandfriends.be website are subject to the availability at the time of the order. The Customer will be informed if the Product requested is not available. Arthur and friends retains ownership of the product until our products have been fully paid by the Customer.

PRICES

All prices on Arthurandfriends.be website are in Euros (EUR). Total costs will be indicated in the confirmation of the order. All product prices include 21% VAT and shipping within the Benelux. Shipments to Germany, France and the UK are also offered with small transport supplement. Other destinations are possible upon request and confirmation and with surplus based on the destination and order volume. If the Customer is resident outside the European Union he/she is responsible for applicable taxes and custom fees according to country's policy.

The prices can vary at any time, especially in case of special offer, promotions or any other marketing efforts. Arthur and Friends does its best to ensure that all pricing information on the Arthurandfriends.be website is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a product shall occur, Arthur and Friends will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If Arthur and Friends is unable to contact the customer the order will be treated as cancelled.

ORDER

The details and the price of the Product are detailed in the product's description. The Customer shall choose the Product by pushing the “buy" button and after having reviewed and accepted the shipping expenses and the Terms and Conditions, he/she shall choose the manner in which he/she wishes to pay and proceed the Order.

The order submitted by the Customer shall be binding for Arthur and Friends only if the entire purchase procedure has been duly and correctly completed without any error. Arthur and Friends will send the Customer within 24 hours an e-mail confirming the receipt of the order placed. The Customer shall verify the content of the e-mail and shall notify Arthur and Friends by writing of any error or other mistake.

PAYMENT

The price is payable upon placement of the order. The customer undertakes to pay the total price of the products and shipping costs outside Belgium as stipulated on the Site or received after quotation. The customer will pay and arrange the customs duties, the VAT or any other taxes due to the import of products in the country of delivery.

Payments on the Arthur and Friends website are through Mollie BV. Specialised in 100% safe online payments. Information needed for finalzing the payment through Molie BV is betwean Mollie BV and the client directly.

Arthur and Friends reserves its right to claim the return of the ordered products in case of non-payment. Under those circumstances, and upon Arthur and Friends request, the customer shall return any product for which the payment has not occurred. SHIPPING AND DELIVERY

Products are delivered to the address indicated by the customer in the order form. Please fill in carefully your address to avoid delivering problems.

Arthur and Friends ships free within the Benelux and with small surcharge to Germany, France and the UK. The fixed rates are variable and changeable, they can be find on the Q&A topic and end of the order form. Shipments in other countries are possible after confirming the additional shipment fee and surplus based on the order and volume. Shipping internationally is available. Shipping quotes are done on a per order basis and dependent on destination. If you are interested in placing an order that requires shipping internationally please contact us at info@arthurandfriends.be. Shipping costs are in any case indicated to the client before he/she confirms the order.

Once payment has cleared, we will dispatch your order. Most often our products are in stock and available for immediate delivery. Please pay attention on the availability notification on the product sheet of all items. We generally ship orders within 10 business days, unless otherwise indicated. Once your order has shipped, you will receive an email notification with tracking information.

Shipping times should take between 2-3 days for Belgium and from 3-10 days elsewhere, depending on the destination.

If the product ordered is not available or is out of stock without being communicated correctly on the product pages separately Arthur and Friends undertakes to inform the customer as soon as possible and to indicate when the product will be available. The customer may, at its option, wait for the availability of the product or obtain a refund.

Delivery shall be deemed to have been made when the products are delivered to the carrier. The delivery note given by the carrier, dated and signed by the customer upon delivery will constitute evidence with regard to transport and delivery. In the event of undelivered products due to Customer absence or wrong address (twice!), the products will be returned to Arthur and Friends which reserves its right to refund to the Customer the price of the products.

SHIPPING DAMAGES

Even though items are packaged properly, transit-related damage can occur. All Arthur and Friends shipments are insured against loss or damage. When an order arrives, please inspect it carefully. If you notice any damage to the boxes please notify us immediately (within 24 hours) at info@arthurandfriends.be for further instructions. Claims will require original packaging and following digital photos:

1- A picture of the complete outside of the box, clearly showing the parcel label

2- A picture of the opened box, clearly showing the content and the interior packing

3- A picture of the complete size of the article

4- A detailed picture (close-up) of the concrete damage of the article.

We will do everything we can to assist you with your claim.

WARRANTY & RETURN

The warranty period specified by law applies. In the event of a product fault that is covered under the terms of the warranty, we shall repair the products, supply a replacement or refund the purchase price at our discretion.

Arthur and Friends offers the high quality product. We take great care in making each piece. We inspect all pieces prior to shipment to make sure its perfect before shipping to our customers. If a shipment arrives with the appearance of shipping damage or a manufacturing defect, please notify us immediately (within 24 hours) at info@arthurandfriends.be and we will do our best to resolve whatever issue there is as quickly as possible.

If the Customer is not satisfied with the product he/she can return it within seven (7) working days of delivery receipt. The Client must inform Arthur and friends by e-mail about the return. Customer after consultation with us can send the Order back on the given address. Arthur and friends reserves the right to refuse a returned product if the customer has not contacted us beforehand. Any goods returned must be returned in its original packaging, in the condition in which Costumer received them, shall neither have been used, nor have suffered any damage. Arthur and Friends is unable to accept returns or offer an exchange or a refund for items that are not returned in exactly the same condition that they were purchased.

Arthur and Friends shall refund the Customer of the purchase price of the product(s) within thirty (30) days from the return product(s) is received. The delivery costs are not refundable. Arthur and Friends will not be held responsible for the refund or the compensation of Products that have been lost, stolen or damaged.

RIGHT OF WITHDRAWAL

For any distance contract the consumer shall have a period of at least fourteen working days from the day of receipt by the consumer in which to withdraw from the contract without penalty and without giving any reason. The only charge that may be made to the consumer because of the exercise of his right of withdrawal is the direct cost ( shipping cost) of returning the goods.

Please note all goods have to be reshipped in its original packaging without damages direct nor indirect. For each return, please contact us upfront on info@arthurandfriends.be and confirm the shipment with order number. All charges ( except shipping charges will be refunded upon receipt and control of the returned goods)

Returns not in compliance with the right of withdrawal are rejected.

LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with Belgian law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Belgian courts in Turhhout.

PERSONAL INFORMATION

Arthur and Friends collect minimum amount of personal information in order to handle orders, deliver products and process payments and refunds. Contact details of the Customers are kept only in the Arthur and Friends database with aim to send personal offers and news. If the Customer does not appreciate Arthur and Friends making any personal offers or news, he/she can let Arthur and Friends know in writing (info@arthurandfriends.be). Customer will not receive any mailing or other forms of news and advertising any more.
